GENERAL CONDITIONS OF ONLINE SALE

General provisions.
These General Conditions of Sale (hereinafter “General Conditions”), governed by the Consumer Code (Legislative Decree no. 206/2005 and subsequent amendments) and by the regulations on electronic commerce (Legislative Decree no. 70/2003 and subsequent amendments), are valid exclusively for distance sales concluded via the web of the products displayed on the domains www.latteriavillacurta.it (hereinafter “each Site”) between the company LATTERIA VILLA CURTA Società Cooperativa Agricola, with registered office in Reggio Emilia, Via P. Montagnani, 19, Fiscal Code and VAT number: 00134600352 (hereinafter “LATTERIA VILLA CURTA”) and any natural person, legal entity and/or individual business (hereinafter “Customer”).
These conditions may be subject to change and the date of publication of the same on the site is equivalent to the date of entry into force.
The languages available for viewing the general terms and conditions of online sales are Italian and English.

Art. 1 – Object of the contract.
Under these General Conditions, LATTERIA VILLA CURTA sells to the Customer, who purchases online, the tangible movable goods listed and offered for sale on the Site (hereinafter the "Products"). The contract is concluded exclusively online, through the Customer's placing a purchase order according to the procedure provided on the Site.

Art. 2 – Pre-contractual information.
Before completing the purchase, the Customer examines the characteristics of the goods illustrated in the individual Product information sheets and declares to have been specifically informed, among other conditions, especially regarding: i) the price of the Products with details of shipping costs, VAT and other taxes if applicable, and any other costs; ii) payment methods; iii) conditions, terms, and procedures for exercising the right of withdrawal; iv) warranties; v) applicable law and jurisdiction. Submitting a purchase order implies the Customer's full knowledge and express acceptance of these General Conditions. The Customer is required to carefully and diligently verify the accuracy of their data contained in the purchase confirmation and to communicate any corrections to LATTERIA VILLA CURTA within and no later than the following 24 hours. By placing an order through the Site, the Customer, if a natural person, guarantees that he or she is of legal age (18 years of age) and has the legal capacity to enter into binding contracts. In any case, the Customer is prohibited from entering false, invented, or fictitious names in the order process or in further communications to LATTERIA VILLA CURTA, which reserves the right to legally prosecute any violation or abuse. The Customer must pay particular attention when completing the order form, as LATTERIA VILLA CURTA cannot be held responsible for data deemed incorrect by the Customer, if such information was sent by the Customer.

Art. 3 – Order.
Customers wishing to purchase Products must indicate their intention by submitting a request directly on the Website, in the dedicated section. Following the procedures indicated therein, they will submit their purchase order and make the payment. The personal data provided for payment purposes will be processed by LATTERIA VILLA CURTA to process the order request and issue the relevant invoicing, with the exception of data relating to payment for the purchased item, which will be communicated directly to the electronic payment system provided by the banks used by LATTERIA VILLA CURTA to enable financial transactions. Under no circumstances will LATTERIA VILLA CURTA be held liable for any fraudulent or improper use of credit cards or similar by third parties. Once the contract is concluded, LATTERIA VILLA CURTA will send the Customer an order confirmation via email containing a summary of the information already included in the order.

Art. 4 – Prices.
Unless otherwise specified in writing, all Product prices are expressed in euros (excluding VAT, which applies based on the destination country and applicable international regulations) and may be subject to change. The Customer must verify the final sales price before submitting the relevant order form. Shipping costs are not included in the price of the Products but are calculated based on the shipping method chosen by the Customer, the destination indicated by the Customer, and the number of packages. Shipping costs are indicated at the time of ordering, when the data required to estimate them is available.

Art. 5 – Payment methods.
Payment can be made by bank transfer, credit card, or PayPal. Payment data and communications are handled over dedicated secure lines and with all the guarantees provided by the security protocols established by electronic payment networks.

Art. 6 – Right of withdrawal for the Consumer.
The right of withdrawal may be exercised, without any reason and without penalty, within 14 days of receipt of the items by the Customer, only if the Customer is a "consumer" as defined in Article 3 of the Consumer Code. Except for custom-made Products with special characteristics, the right of withdrawal cannot be exercised. The Products must be returned in the same condition in which they were received, i.e., in perfect condition, complete with all their parts, with the original packaging and any accompanying manuals, unused, worn, or damaged. Shipping must be free of charge. The intention to withdraw must be communicated within 14 days of receipt of the Products by contacting LATTERIA VILLA CURTA by telephone (at +39 0522 551819), by fax at +39 0522 5518197, or by sending an email to info@latteriavillacurta.it. The costs of returning the goods, as well as all transport risks, will be borne entirely by the Customer. The goods must be sent to: LATTERIA VILLA CURTA, Via Montagnani, 19 - Loc. Villa Curta - 42122 Reggio Emilia, and the Customer must retain proof of return. All returns, beyond the deadlines applicable to the right of withdrawal, must be expressly authorized in writing by LATTERIA VILLA CURTA. The Customer is required to return the goods without undue delay, intact and in the original packaging complete in all its parts, and in any case within 14 days from the date of exercising the right of withdrawal. LATTERIA VILLA CURTA, having verified compliance with the above, will refund the amount of the products subject to withdrawal, using the same payment method used by the Customer for the initial transaction. LATTERIA VILLA CURTA reserves the right to refuse the return of products that have been altered from their essential and/or qualitative characteristics or that have been damaged. In this case, LATTERIA VILLA CURTA will return the goods to the Customer, charging the latter the shipping costs.

Art. 7 – Delivery methods.
LATTERIA VILLA CURTA will deliver the products purchased by the Customer through specialized carriers specifically appointed by LATTERIA VILLA CURTA. Delivery times are those indicated in the purchase order and specified in the purchase order confirmation and may vary based on the destination, cost, and volume of the goods. LATTERIA VILLA CURTA will not be responsible for delays caused by incorrect address information or other information required to deliver the Products. Upon delivery of the Products to the Customer by the carrier responsible for their transportation, the Customer must check, in the presence of the carrier, that: a) the quantity and type of Products ordered corresponds to that indicated in the transport document; b) the packaging used for transport is intact, not damaged or otherwise altered, even just the sealing materials; c) the quantity and type of Products delivered corresponds to that ordered. If the packaging shows obvious signs of tampering or alteration, the Customer must notify LATTERIA VILLA CURTA by email and/or registered letter within 24 hours. For each order placed on the site, LATTERIA VILLA CURTA will issue an invoice for the shipped goods, which will be sent via email or post to the order holder or included in the package shipped to the Customer.

Art. 8 – Warranty.
The Products offered for sale on the Site comply with the national and EU legislation in force in Italy regarding Products for low voltage use. The designs, images, and colors of the Products for sale on the Site are intended for illustrative purposes only and may differ from the actual colors due to the local settings of the systems and/or tools used to view them. The Customer must refer exclusively to the characteristics described in the product's technical data sheet available for each individual Product. Any inaccuracies or non-substantial differences between the representation on the Site and the actual Product cannot be considered a breach of contract. Products altered in any way or without their original packaging are excluded from the warranty. Also excluded from the warranty are any other defects caused by accidental events or the user's responsibility, or by non-compliant or improper use of the Product for its intended purpose and/or as provided in the documentation accompanying the Product, where applicable, provided by LATTERIA VILLA CURTA to the Customer. To benefit from the warranty, the Customer must provide proof of purchase and delivery of the goods. In the event of a Product's lack of conformity with the characteristics published on the Site: a) if the Customer is a Consumer, as defined in art. 3 letter a) of the Consumer Code, the Customer has the right to avail of the guarantee provided by the Consumer Code, which requires the Consumer, under penalty of forfeiture, to report to LATTERIA VILLA CURTA any lack of conformity found in the purchased Product within 2 (two) years of discovering it. Following such report, the Consumer will have the right to request the replacement of the individual Product, without prejudice to other rights provided by law. b) if the Customer is a Professional, as defined in art. 3 letter c) of the Consumer Code, the Customer has the right to avail of the legal guarantee provided by the Italian Civil Code, which requires the Professional Customer to report, under penalty of forfeiture, to LATTERIA VILLA CURTA any lack of conformity found in the purchased Product within 8 (eight) days of discovering it. The warranty is valid for a maximum of 12 (twelve) months from delivery of the Product.

Art. 9 – Applicable law and competent court.
The sales contract concluded according to these General Conditions is deemed to have been concluded in Italy and is governed by Italian law. Any dispute concerning the interpretation, execution, or validity of the sales contract concluded through the Site will be subject to the exclusive jurisdiction of the Court of Reggio Emilia, unless the Customer has acted and concluded this contract as a Consumer for purposes unrelated to their business or professional activity: in that case, the Court of the place where the Customer has their residence or domicile will have jurisdiction.

Art. 10 – Complaint.
Any complaints must be addressed to LATTERIA VILLA CURTA, by sending a registered letter with return receipt to the following address: LATTERIA VILLA CURTA, Via Montagnani, 19 - Loc. Villa Curta - 42122 Reggio Emilia.

Art. 11 – Site Contents and Intellectual Property Rights.
The contents of the Site, including but not limited to the works, images, photographs, dialogues, music, videos, documents, drawings, figures, logos, and any other material published on the Site, are protected by copyright and all other intellectual property rights of LATTERIA VILLA CURTA and other rights holders. Reproduction, modification, duplication, copying, or any other exploitation of the images and content of the Site is prohibited without prior written authorization from LATTERIA VILLA CURTA. Any use of the Site's content for commercial and/or advertising purposes is also prohibited.

Art. 12 – Processing of personal data.
Customer data is processed by LATTERIA VILLA CURTA in accordance with the provisions of the legislation on the protection of personal data, as better specified in the information available in the specific "Privacy" section on the Website.
